Fanatics Bay Special Promotion 2022/23 season 

TERMS & CONDITIONS

These Terms & Conditions apply to 2023 Fanatics Bay 'inaugural year inclusions' promotion. 

The full Terms and Conditions relating to Fanatics Bay full season membership are available to read here. 

In these Terms & Conditions, we will refer to the North Queensland Toyota Cowboys as ‘us’, ‘we' and ‘our’. We will refer to a Fanatics Bay member in these Terms & Conditions as a ‘Fanatics Bay member’, ‘member’, ‘you’ and ‘your’.

By participating in this promotion, you acknowledge and agree that you have read and understood these Terms & Conditions and that each other member listed in your membership account has read and understood or will comply with these Terms & Conditions.

Nothing in these Term & Conditions amends, limits or excludes any rights or remedies that a member may have under the Australian Consumer Law which cannot lawfully be amended, limited or excluded.

Please read these Terms & Conditions prior to participating in the promotion. 

Eligibility criteria

1. Only 2022/23 Fanatics Bay full season members who join before the date of the first home game of the 2023 season are eligible to participate in this promotion. 

Promotion overview

2. The Fanatics Bay membership category was launched at the commencement of the 2023 season, replacing the 2021/22 Gold Star full season seating in Bay 117.

3. To promote the launch of Fanatics Bay membership, exclusive inclusions for the first year include:

a. an invitation to participate in a lap of honour on the field of play at Queensland Country Bank Stadium at a home game during the 2023 season, and

b. the chance to win exclusive access to the Cowboys Corral, a dedicated function area within Bay 117 at Queensland Country Bank Stadium, during one home game in the 2023 season. 

Invitation to participate in a lap of honour

4. All 2022/23 Fanatics Bay members will be invited to participate in a lap of honour on the field of play at Queensland Country Bank Stadium at a Cowboys home game during the 2023 season.

5. Each member will receive one (1) invitation to participate at one (1) home game during the 2023 season.

6. Members will be allocated with one randomly chosen home game to attend the lap of honour during the 2023 season and will not be given the opportunity to choose or move the date of their allocated game.

7.  If the member is unable to attend on the date of their allocated home game, they will forfeit their invitation and no alternative date will be offered. 

8. The invitation is strictly non-transferrable.

9. The invitation cannot be exchanged for cash, credit or alternative inclusions.

10. The promotion is conditional upon Queensland Health and/or National Rugby League Covid-19 protocols enabling it to go ahead.

11. Due to this promotion occurring on the field of play, participants may be required to undertake a Rapid Antigen Test (RAT) and return a negative result, prior to participating. 

12. Refusal to undertake a RAT will mean the member will forfeit their invitation with no alternative offered. 

Chance to win exclusive use of Cowboys Corral for one home game

11. All 2022/23 Fanatics Bay members will be be given the opportunity to win exclusive use of the Cowboys Corral at Queensland Country Bank Stadium at a Cowboys home game during the 2023 season.

12. Six (6) Fanatics Bay members will be chosen to each receive exclusive use of the Cowboys Corral for one home game. 

13. Exclusive use includes entry for that member plus nine (9) of their guests to the Cowboys Corral event space at the top of Bay 117 for one home game.

15. If the Member invites guests who do not hold membership or a game ticket for their allocated home game, they will be provided one game ticket each to Queensland Country Bank Stadium for that game. 

16. Game tickets include access to one grandstand seat for use at that home game.

17. A home game will be allocated to each winner by the Cowboys Membership team, with no option for the member to choose or move their allocated game. 

18. Members will be chosen via a random draw conducted by the Cowboys Membership team. Final winners will be at the discretion of the Cowboys Membership team and no correspondence will be entered into regarding the decision. 

19.  If the member is unable to attend on the date of their allocated home game, they will forfeit their invitation and no alternative date will be offered. 

20. No food, drink or merchandise is included in the prize. 

21. The prize is strictly non-transferrable.

22. The prize cannot be exchanged for cash, credit or alternative inclusions.

General requirements to participate in the promotion

23. It is the responsibility of the winner to arrange their attendance at the Queensland Country Bank Stadium to participate.

24. The Cowboys will not subsidise or reimburse any travel or out-of-pocket costs accrued by members to participate. 

25. While participating, members must abide by all instructions given by Cowboys staff to ensure all health, safety and confidentiality requirements are adhered to.

26. Participants are encouraged to wear flat, comfortable footwear as you will be required to traverse stairs.

27. Members must notify us of any special requirements (i.e. accessibility requirements) at the time they advised of their participation in the lap of honour or Cowboys Corral. The Cowboys will make every endeavour, however cannot guarantee all special requirements will be met in all instances.

28. The Cowboys retains the right to alter or cancel promotion inclusions, dates or times if unforeseen circumstances occur. Although every effort is made, the Cowboys shall not be liable for any illness, injury, damages, loss, delay or failure to participate that may occur due to factors beyond our control.

General terms

29. All prices set out on this website and these Term & Conditions are GST-inclusive.

30. All members agree to the terms of entry of Queensland Country Bank Stadium as may be amended by the owner or operator of Queensland Country Bank Stadium from time to time.  We reserve the right to suspend or cancel your participation in this promotion if you breach the terms of entry of Queensland Country Bank Stadium, breach the Cowboys Members & Fans Code of Conduct or have been removed by security or police from Queensland Country Bank Stadium.

31. We may cancel part or all of an event to which your membership applies (including games and other events) (“Cowboys Event”) if an event outside our reasonable control occurs that impacts or may impact on the relevant Cowboys Event including, but not limited to, fire, storm, flood, tsunami, earthquake, explosion, war, invasion, rebellion, sabotage, epidemic, pandemic (including the Covid-19 pandemic), government intervention or orders (whether mandatory or recommended), labour dispute, labour shortage, failure or delay in transportation and act or omission of any third person (including the NRL, subcontractors, customers, governments or government agencies) (each such event a “Force Majeure Event”). If a Force Majeure Event occurs that affects a Cowboys Event, or the ability for a Cowboys Event to be held, we will use reasonable endeavours to notify you. However, where the event is sudden or last-minute, this may not be possible. While we do not offer refunds for Cowboys Events cancelled in whole or in part due to Force Majeure Events, before or after the Force Majeure Event occurs, we will contact you about whether the affected Cowboys Event will be rescheduled or what other options we may be able to offer to you.

32. We are not the owners or operators of Queensland Country Bank Stadium. We do not make any representation or warranty that your attendance at the stadium (whether reserved or unreserved) will be unaffected by any of the Force Majeure Events referred to in clause 56 that may occur before, during or after a game or event. You acknowledge and agree that such Force Majeure Events are beyond our control and may impact on your enjoyment of, or ability to watch, an event or game.

33. The North Queensland Toyota Club’s primary means of communication is email however we may also need to contact you by phone or other methods about matters relating to your participation in the promotion. You must inform us of any changes to your contact details and make sure your contact details are complete and correct.

34. When you join as a member, you consent to receiving:

a. club updates and offers;

b. sponsor and partner offers; and

c. NRL ticketing offers.

35. You can unsubscribe or change your preferences for the types of emails you receive by following the link to the preference centre at the bottom of any Cowboys’ email.

36. It is a condition of financial membership that members give consent to Cowboys Rugby League Football Limited, its affiliates and agents, to use their image and likeness and/or any interview statements from members in its publications, advertising or other media activities (including the Internet), without compensation or other remuneration, now or in the future. 

37. By participating in this promotion, you provide this consent, and you represent that any others who participate on your behalf (i.e. Corral guests) also give the same consent.

38. We will need to collect personal information from you and persons on your membership account (such as your name, age and contact details). In providing this information to us, you agree to the terms of our privacy policy, which you can view here: Privacy Policy

Papua New Guinea Australia Post Delivery Suspended

39. At the commencement of the 2023 NRL season, Australia Post have advised courier and express parcel deliveries are suspended to Papua New Guinea from Australia. 

40. For the delivery of membership merchandise packs for members based in Papua New Guinea, these members will be given the choice of:

A) providing an Australian delivery address for their merchandise pack

B) nominating a date to collect their merchandise pack from Cowboys HQ at the Hutchinson Builders Centre, 26 Graham Murray Place, Townsville QLD Australia before the last home game of 2023 

C) choosing not to receive a members merchandise pack

D) opting out of membership.

41. If a member chooses not to receive a members merchandise pack due to the above postal restrictions, no discount will be offered on the price of membership.
