TERMS AND CONDITIONS

1.      Promoter and acceptance

·       The promoter is Cowboys Rugby League Football Limited (ABN 28 060 382 961) of Hutchinson Builders Centre, 26 Graham Murray Place, Railway Estate QLD 4810 (“Promoter”, “we”, “us”, “our”).

·       By entering this promotion the Entrant agree to these Terms and Conditions.

·       Nothing in these Terms and Conditions limits any rights the Entrant may have under the Australian Consumer Law that cannot lawfully be limited.

2.      Promotion overview

·       This is a game of chance conducted during the North Queensland Toyota Cowboys 2026 home game season.

3.      Promotional period

·       The promotion commences at 12.00pm (AEST) on Sunday, 22 March 2026 and closes at 7.30pm (AEST), Saturday, 29 August 2026  (“Promotional Period”).

4.      How to enter

·       Eligible entrants who upload their entry and complete the Promoter’s online entry form during the Promotional Period will go into the draw to win the Grand Prize.

·       To enter, during the Promotional Period, the Entrant must:

a)       Go to https://comps.cowboys.com.au/tb_app/545776876 and click on the promotional link to upload a video, photo or message of how would a Toyota vehicle fit into your lifestyle.

b)      Complete all the required data entry fields on the entry form.

c)      Each entry must be the entrant’s original work. By entering this competition entrants:

                                i.            warrant that their entry does not include any content that contravenes any law, infringes the rights of any third party, is obscene, offensive, discriminatory, indecent, otherwise objectionable or inappropriate or makes any improper or inappropriate invasion of the privacy of any person. Without limitation, entrants must not include any content that involves nudity, malice or which may be defamatory or in contempt of court;

                               ii.            must ensure that they have permission from all individuals shown in any photo or video before it is uploaded, and that all persons appearing in any photo or video are 18 years of age or older (or, if any person is under 18 years of age, that their parent’s or guardian’s consent has been provided);

                             iii.            confirm that they own the copyright in any photo or video the entrant submits. If the entrant is under the age of eighteen (18) years, then their parent or legal guardian must own the copyright in the photo or video;

                             iv.            undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights;

                               v.            grant the Promoter a world-wide, royalty free, perpetual, irrevocable, transferrable licence (with a right to sublicense) to use their entry submitted as part of this promotion for any purpose; and

                             vi.            acknowledge that their entry and their name may be made publicly available by the Promoter (in its absolute discretion) and will be accessible to the general public to view.

·       Entry is free. Any costs associated with internet access or device use are the Entrants responsibility.

·       Limit: one (1) entry per person per Entry Period.

5.      Eligibility

·       Entry is open to Australian residents who live and reside in Queensland, aged eighteen (18) years or over.

·       Directors, officers and employees of the Promoter and its related bodies corporate, and their immediate families, are not eligible.

·       The Promoter may verify eligibility and may disqualify entries that are incomplete, illegible, misleading or fraudulent.

·       Any travel, accommodation or out-of-pocket costs accrued by participants to compete in the Promotion will be at their own expense

6.      Draw and winner notification

·       Two finalists will be randomly drawn from all eligible entries received during the Promotion Period. The draw will take place at the Promoter’s offices on Monday, 31 August 2026 (i.e. 24 hours after the end of the Promotion Period) using a computerised random selection method.  The two drawn finalists will be required to attend The Cowboys NRL Home Game 12 (Round 27) on 5 September 2026 at Queensland Country Bank Stadium, Townsville, where they will receive the opportunity to take part in a separate challenge during half time at the game to win the Grand Prize (“Grand Final challenge”). The two finalists are responsible for making their own way to and from the Cowboys Home Game 12 (Round 27) on 5 September 2026.

·       The two finalists drawn will be contacted by phone twenty-four (24) hours of the draw, and have two business days to confirm their participation in the Grand Prize challenge.

·       If a finalist is not contactable or cannot confirm their ability to participate within two (2) business days of being notified they are a finalist, they will forfeit their selection as a finalist and will not be entitled to participate in the Grand Prize challenge.

·       At the game, the two (2) finalists will be invited to participate in the Grand Prize challenge, where the Promoter will flip a coin to determine which of the two finalists picks a box first.

·       The relevant selected finalist will then have two boxes to choose from, and one of those boxes will contain the key to the Grand Prize (the Toyota Hilux SR5). Through process of elimination, the winner of the Grand Prize will be the finalist who successfully opens the box which contains the key to the Grand Prize.

·       The two finalists must fully comply with the Promoter’s instructions and directions regarding the Grand Prize challenge at all times as specified by the Promoter, including by wearing any promotional clothing or other items as required by the Promoter (which will be provided to the finalists before participating in the Grand Prize challenge). A finalists must not interfere with the other finalist (including, but not limited to, touching or otherwise making any contact with or distracting the other finalist or acting in any manner which is deemed by the Promoter as being dangerous, inappropriate or reckless) or engage in any unsportsmanlike conduct. The finalists must not consume any alcohol at the Grand Prize challenge. The Promoter reserves the right to disqualify a finalist who fails to comply with the Promoter’s instructions, the event rules or these conditions of entry.

·       If a finalist is unable to participate in the Grand Prize challenge on 5 September 2026, the finalist may nominate a proxy to participate in the Grand Final challenge on their behalf. The finalist must nominate a suitable proxy prior to the Grand Final challenge taking place. In that case the nominated proxy:

a)       must be aged 18 years or over and able to participate in the Grand Final challenge on 5 September 2026;

b)      accepts and agrees to be bound by these conditions of entry and any additional conditions provided by the Promoter or prize suppliers and must execute any document the Promoter requires for this purpose; and

c)       the nominated proxy will not receive any prizes on the relevant finalist’s behalf.

·       The relevant finalist accepts all decisions made by the nominated proxy.

·       If the Entrant nominates a proxy, the Promoter accepts no liability for disputes arising between the finalist and the proxy over their participation in the Grand Final challenge or ownership of the Grand Prize.

·       If a finalist forfeits their position in the Grand Prize challenge for any reason, another finalist will be randomly drawn from eligible entries if time allows.

·       If a finalist forfeits after gates open on the day of the Grand Prize challenge, the Promoter reserves the right to select a finalist from outside of the entry pool (i.e. a member of the public) to ensure the promotion can proceed at half time.

·       On game day, the finalists must arrive 90 minutes before kick-off (approximately at 4:00pm AEST) to meet their Cowboys contact. If this does not happen, the finalist may be disqualified from the promotion, and the Promoter will draw another entrant from the entry pool or the crowd.

7.      Prize Pool

·       The Grand Prize is a Toyota HiLux SR5 auto (including all statutory and on-road costs) valued at over $70,000 (inc GST). The Grand Prize will be transferred to the winner within fourteen (14) business days following the NRL home game 12 (Round 27) on 5 September 2026.

·       The Grand Prize is not transferable, exchangeable or redeemable for cash. The Promoter accept no responsibility for any variation in the value of the Grand Prize. To the extent permitted by law, the Promoter make no representations or warranties as to the quality, suitability, or merchantability of the Grand Prize.

·       Where the Grand Prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as reasonably determined by the Promoter.

 

8.       Additional details

·       The Grand Prize does not include comprehensive insurance or any accessories not specified. The winner must arrange to attend the premises of the dealer nominated by the Promoter to collect the vehicle. The winner must provide all information and sign all documentation necessary to enable the Promoter to register the vehicle in the name of the winner prior to collection. To be eligible to claim the vehicle, the winner must be capable of obtaining registration of the vehicle in his or her name in accordance with the applicable legislation in the state or territory in which the vehicle is collected. If the winner is, through any legal incapacity or otherwise, unable to register the vehicle in his or her name then he or she may, notwithstanding any other paragraph of these conditions, assign the vehicle to another person with legal capacity for the purpose of registration of the vehicle.

9.      Claiming prize requirements

·       For the winner to claim the Grand Prize, the winner must provide their IR or current drivers licence at the Townsville Toyota Dealer (unless otherwise advised by the Promoter).

·       The winner agrees to have their photo/vision captured with the Grand Prize for use on Cowboys media channels.

10.  Publicity

·       With the winner’s consent, the Promoter may use the winner’s first name, suburb, and (if provided) image/likeness for promotional purposes in any media, for up to 12 months after the draw, without additional compensation.

·       If the winner does not consent, this will not affect their ability to claim the Grand Prize.

11.  Privacy (collection notice)

·       If the Entrant does not provide the requested information, the Promoter may not be able to register the Entrants entry, contact the Entrant if they win, or award the Grand Prize.

·       We may disclose personal information to service providers who assist us to run the promotion and manage surveys, communications and data hosting (for example email/SMS providers and IT hosting providers). We require those providers to handle personal information securely and only for authorised purposes.

·       Some service providers may store or process information outside Australia (for example where cloud infrastructure is located). Where we disclose personal information overseas, we take reasonable steps to ensure overseas recipients handle it in a way consistent with the Australian Privacy Principles.

12.  Direct marketing

·       If the Entrant opts in to receive marketing from us, we may use the Entrant’s contact details to send the Entrant information about ticketing, offers, merchandise and related initiatives. The Entrant can opt out at any time by using the unsubscribe mechanism in the Promoter’s messages or by contacting the Promoter directly.

·       If the Entrant does not opt in, the Promoter will still send messages that are necessary to administer this promotion (for example winner notifications).

 

13.  Liability

·       The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, the Grand Prize challenge or accepting or using any prize (including the Grand Prize), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth). By entering this promotion, entrants acknowledge and agree to accept this risk.

14.  General

·       The Promoter’s decisions are final, and no correspondence will be entered into.

·       The Promoter is not responsible for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, or for any technical disruptions.

·       The Promoter may cancel part or all of promotion if an event outside the Promoter’s reasonable control occurs that impacts or may impact on the promotion including, but not limited to, fire, storm, flood, tsunami, earthquake, explosion, war, invasion, rebellion, sabotage, epidemic, pandemic (including the Covid-19 pandemic), government intervention or orders (whether mandatory or recommended), labour dispute, labour shortage, failure or delay in transportation and act or omission of any third person (including the NRL, subcontractors, customers, governments or government agencies) (each such event a “Force Majeure Event”).

·       If a Force Majeure Event occurs that affects the promotion, or the ability for it to be held, we will use reasonable endeavours to notify the Entrant. However, this may be impossible if the event is sudden or last-minute. While the Promoter does not offer compensation for cancelled promotions in whole or in part due to Force Majeure Events, before or after the Force Majeure Event occurs, the Promoter will contact the Entrant about whether the affected Promotion will be rescheduled or what other options we may be able to offer to the Entrant.

·       All entrants agree to the terms of entry of Queensland Country Bank Stadium as may be amended by the owner or operator of Queensland Country Bank Stadium from time to time.  The Promoter reserves the right to suspend or cancel the Entrant’s participation in the Promotion if the Entrant breaches the terms of entry of Queensland Country Bank Stadium, breach the Cowboys Members & Fans Code of Conduct or have been removed by security or police from Queensland Country Bank Stadium.
